Welcome to wcfm.app (the “Site”), a branch of our main site wclovers.com, operated by Trihiya Solutions Pvt. Ltd., (collectively, “WCLovers”, “WCFM”, “wcfmapp”, “we”, “us”, “our”).  By accessing, viewing, downloading, or otherwise using the Site or any webpage or service available via the Site, or using our WCFM made apps, you, the user of the Site, (collectively, “Client”, “Customer”, “user”, “visitor”, “you”) acknowledge and agree to be bound by the following Terms and Conditions (the “Terms of Use”).  We reserve the right, at our sole discretion, to change, modify, add, or delete portions of these Terms of Use on this page and will indicate at the top of this page the date these terms were last revised.  Your continued use of the Site or apps after any such changes constitutes your acceptance of the new Terms of Use.  If you do not agree to abide by these or any future Terms of Use, DO NOT CONCLUDE THIS AGREEMENT, AND DO NOT USE OR ACCESS (or continue to use or access) the SITE, VIEW, DOWNLOAD, OR OTHERWISE USE ANY WCLovers WEBPAGE, INFORMATION OR SERVICES THEREIN.  It is your responsibility to regularly check the Site to determine if there have been changes to these Terms of Use and to review such changes.

1. Limitation of Liability

Under no circumstances shall WCLovers be liable for any direct, indirect, special, incidental or consequential damages, including, but not limited to, loss of data or profit, arising out of the use, or the inability to use, the materials on this site, even if WCLovers or an authorized representative has been advised of the possibility of such damages.

2. Ownership and Liability

You shall not claim intellectual or exclusive ownership to any of our products, modified or unmodified. All products are the property of WCLovers. Our products are provided “as is” without warranty of any kind, either expressed or implied. In no event shall our juridical person be liable for any damages including, but not limited to, direct, indirect, special, incidental or consequential damages or other losses arising out of the use of or inability to use our products.

User Accounts, Product Licenses, App Source code are not transferable.

3. Payment

A Plan that involves recurring payment, will get automatically deducted from your PayPal account. You will get multiple email notifications before your payment date. It’s your responsibility to have sufficient balance in your PayPal account. Failed to do so will result in deactivation of your plan and hence you will not receive any update or support for the purchased product afterwards. In some cases reactivation might not be possible (if the last payment date is older than 60 DAYS) for that you will need to purchase a new plan from our pricing page.

Recurring payments can be cancelled ANYTIME from your my account page.

4. Refund Policy

As per our ‘All sales final’ policy, no refunds shall be made on the purchase. Please make sure that the features you’re looking for are part of the wcfmapp product plan. Refer to pricing page to know the packages and the features offered. If you need more details feel free to reach via our contact us page.

5. Warranty

Our products are provided “as is” without warranty of any kind, either expressed or implied. We do not guarantee compatibility with any additional third party services, scripts, or applications.

However, you can always check the features on our FREE app before purchasing to be sure about the issues. Our contact form is always there to help you.

6. Product Updates

Product updates will only be offered under the FREE plan and BUSINESS PLUS plan. No updates will be provided for the App under BUSINESS plan.

The frequency of updates are based on our internal development milestones and bug fixing priorities. There is no fixed time cycle or interval for our product updates.

7. Account Termination and Suspension

WCLovers reserves the right to suspend and/or terminate any user account without notice. This may be due to one or several of the following reasons.

a. Abusive behavior and/or excessive negativity towards the WCLovers staff and/or other WCLovers customers.
b. Repeated defamatory, malicious, and/or false statements including slander against WCLovers, and/or attempts to persuade potential customers away from purchasing WCLovers products.
c. Promoting competitor products, contributing to software piracy, hacking, spamming, or other illegal acts.
d. We reasonably believe that your account has been compromised, shared with others, or for other security reasons. All decisions are final and terminated or suspended accounts will not be reversed.

8. Termination of Service

WCLovers reserves the right in its sole discretion to cease or suspend providing all or any part of the Service immediately without any notice to you, if: (a) you breach, or threaten or intend to breach, these Terms; (b) WCLovers is required to do so under any applicable law, rule or regulation, including, without limitation; (c) continuing to provide the Service could create a substantial economic burden on WCLovers as determined by WCLovers in its sole discretion; or (d) continuing to provide the Service could create a security risk or material technical burden as determined by WCLovers in its sole discretion; or (e) any other purpose as determined by WCLovers in its sole discretion.

9. Copyright

The Client retains the copyright to data, files and graphic logos provided by the Client, and grants WCLovers the rights to publish and use such material. The Client must obtain permission and rights to use any information or files that are copyrighted by a third party. The Client is further responsible for granting WCLovers permission and rights for use of the same and agrees to indemnify and hold harmless WCLovers from any and all claims resulting from the Client’s negligence or inability to obtain proper copyright permissions. A contract for App design and/or development shall be regarded as a guarantee by the Client to WCLovers that all such permissions and authorities have been obtained. Evidence of permissions and authorities may be requested in some cases.

10. Support

WCLovers strives to provide adequate and efficient technical support, upgrades and updates for the Products and Services offered. WCLovers shall not, however, be under any obligation to provide support or maintenance for the Products or Services under these Terms and reserves the right to limit the support, upgrades and updates provided from time to time.
