Welcome to wcfm.app (the “Site”), a branch of our main site wclovers.com, operated by Trihiya Solutions Pvt. Ltd., (collectively, “WC Lovers”, “WCFM”, “wcfmapp”, “we”, “us”, “our”). By accessing, viewing, downloading, or otherwise using the Site or any webpage or service available via the Site, or using our WCFM made apps, you, the user of the Site, (collectively, “Client”, “Customer”, “user”, “visitor”, “you”) acknowledge and agree to be bound by the following Terms and Conditions (the “Terms of Use”). We reserve the right, at our sole discretion, to change, modify, add, or delete portions of these Terms of Use on this page and will indicate at the top of this page the date these terms were last revised. Your continued use of the Site or apps after any such changes constitutes your acceptance of the new Terms of Use. If you do not agree to abide by these or any future Terms of Use, DO NOT CONCLUDE THIS AGREEMENT, AND DO NOT USE OR ACCESS (or continue to use or access) the SITE, VIEW, DOWNLOAD, OR OTHERWISE USE ANY WCLovers WEBPAGE, INFORMATION OR SERVICES THEREIN. It is your responsibility to regularly check the Site to determine if there have been changes to these Terms of Use and to review such changes.
1. Limitation of Liability
Under no circumstances shall WC Lovers be liable for any direct, indirect, special, incidental or consequential damages, including, but not limited to, loss of data or profit, arising out of the use, or the inability to use, the materials on this site, even if WC Lovers or an authorized representative has been advised of the possibility of such damages.
2. Ownership and Liability
You shall not claim intellectual or exclusive ownership to any of our products, modified or unmodified. All products are the property of WC Lovers. Our products are provided “as is” without warranty of any kind, either expressed or implied. In no event shall our juridical person be liable for any damages including, but not limited to, direct, indirect, special, incidental or consequential damages or other losses arising out of the use of or inability to use our products.
User Accounts, Product Licenses and App Source codes of all WCFM Apps namely WCFM Store Manager App Advanced and WCFM Delivery App are non- transferable.
3. Payment
A Plan that involves recurring payment, will get automatically deducted from your credit card or PayPal account, whichever payment method you have chosen for your last payment. You will get multiple email notifications before your payment date. It’s your responsibility to have sufficient balance in your PayPal account. Failed to do so will result in the deactivation of your plan and hence you will not receive any update or support for the purchased product afterward. In case the last payment due date is older than 60 DAYS, reactivation of the plan will not be possible. In such cases, you will need to purchase a new plan from our pricing page.
Recurring payments can be canceled ANYTIME from your my-account page.
4. Refund Policy
As per our ‘All sales final’ policy, under no circumstances shall any refund(s) be made post purchase of any WCFM Apps’ (WCFM Store Manager App Advanced and WCFM Delivery App) Whitelabeling and Source Code Plans. Please make sure that the features you’re looking for are part of the apps’ whitelabeling plan or source code plan, whichever you purchase. Refer to the pricing page to know the packages and the features/services offered. If you need more details, feel free to reach via our contact us page.
5. Warranty
Our products are provided “as is” without warranty of any kind, either expressed or implied. We do not guarantee compatibility with any additional third party services, scripts, or applications.
However, you can always check the features on our FREE versions of the apps ( WCFM Store Manager App and WCFM Delivery App) at Google Play Store before purchasing to be sure about the issues. Our contact form is always there to help you.
6. Product Updates
Product updates (in case of WCFM Apps) refer to software development updates on WCFM Apps done by the apps development team of WC Lovers. The frequency of updates are based on our internal development milestones and bug fixing priorities. There is no fixed time cycle or interval for our product updates. The terms and conditions of any update is solely under the decision of WC Lovers.
Product Updates will only be offered under the FREE apps published in Google Play Store, WHITE LABELING PLANS – WITH UPDATES (for both monthly and annually payment methods), SOURCE CODE – WITH UPDATES ( both monthly and annually ). No updates will be provided for any WCFM Apps under plans that are mentioned as Without Updates (both Whitelabeling and Source Code). If you purchase any without update plans compatibility of your app with your WordPress website with future updates of the website and/or updates of any WordPress plugins, themes and/or updates in the google app policy/structure/framework version and/or Onesignal Notification library and/or any other libraries related to WordPress or apps version depends on your sole responsibility.
No other customization, beyond what is mentioned under the plan, will be provided under the Whitelabeling Plan. If you require any customization beyond the modifications mentioned for the plan, you will have to contact the support team for your requirements. Under no circumstances shall WC Lovers be liable and/or bound to any kind of customization in any of the WCFM Apps.
7. Account Termination and Suspension
WCLovers reserves the right to suspend and/or terminate any user account without notice. This may be due to one or several of the following reasons.
a. Abusive behavior and/or excessive negativity towards the WC Lovers staff and/or other WC Lovers customers.
b. Repeated defamatory, malicious, and/or false statements including slander against WC Lovers, and/or attempts to persuade potential customers away from purchasing WC Lovers products.
c. Promoting competitor products, contributing to software piracy, hacking, spamming, or other illegal acts.
d. We reasonably believe that your account has been compromised, shared with others, or for other security reasons. All decisions are final and terminated or suspended accounts will not be reversed.
8. Termination of Service
WCLovers reserves the right in its sole discretion to cease or suspend providing all or any part of the Service immediately without any notice to you, if: (a) you breach, or threaten or intend to breach these terms; (b) WC Lovers is required to do so under any applicable law, rule or regulation, including, without limitation; (c) continuing to provide the Service could create a substantial economic burden on WC Lovers as determined by WC Lovers in its sole discretion; or (d) continuing to provide the Service could create a security risk or material technical burden as determined by WC Lovers in its sole discretion; or (e) any other purpose as determined by WC Lovers in its sole discretion.
9. Copyright
The Client retains the copyright to data, files and graphic logos provided by the Client, and grants WC Lovers the rights to publish and use such material. The Client must obtain permission and rights to use any information or files that are copyrighted by a third party. The Client is further responsible for granting WC Lovers permission and rights for use of the same and agrees to indemnify and hold harmless WC Lovers from any and all claims resulting from the Client’s negligence or inability to obtain proper copyright permissions. A contract for App design and/or development shall be regarded as a guarantee by the Client to WCLovers that all such permissions and authorities have been obtained. Evidence of permissions and authorities may be requested in some cases.
10. Support
WC Lovers strives to provide adequate and efficient technical support, upgrades and updates for the Products and Services offered. WC Lovers shall not, however, be under any obligation to provide support or maintenance for the Products or Services under these Terms and reserves the right to limit the support, upgrades and updates provided from time to time. Under no circumstances shall WC Lovers provide any support for inability to setup the app in case of purchase of Source Code.
